  • Call recordings: Duration of program plus 1 year for quality assurance

9. Your Privacy Rights

Depending on your location, you may have the right to access and port your data, request correction of inaccurate information, request deletion (subject to legal retention requirements), opt out of marketing communications and targeted advertising, request restriction of processing, and object to processing for marketing purposes.

10. International Data Transfers

Your information may be transferred to and processed in countries other than your country of residence, including the United States. These countries may have different data protection laws. By using our services, you consent to the transfer of your information to the United States and other countries.

11. Children's Privacy

Our services are not directed to individuals under the age of 18. We do not knowingly collect personal information from children. If we become aware that we have collected information from a child under 18, we will take steps to delete such information.

12. Canadian Privacy Rights (PIPEDA)

Because our services are primarily offered to advisors in Canada, we handle personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and, where applicable, substantially similar provincial privacy laws in Alberta, British Columbia, and Quebec.

  • Consent: We collect, use, and disclose personal information with your knowledge and consent, except where permitted or required by law. You may withdraw consent at any time, subject to legal and contractual restrictions
  • Limiting collection and use: We collect only the information needed for the purposes identified in this policy, and we do not use it for new purposes without further consent
  • Access and accuracy: You may request access to the personal information we hold about you and ask us to correct inaccuracies
  • Safeguards and retention: We protect personal information with security measures appropriate to its sensitivity and retain it only as long as necessary for the purposes described in Section 8

To make a PIPEDA request, email info@fondako.com with "PIPEDA Request" in the subject line. We respond within 30 days. If you are not satisfied with our response, you may file a complaint with the Office of the Privacy Commissioner of Canada (priv.gc.ca).

Cross-border transfers: Personal information of Canadian residents may be stored or processed by our service providers in the United States and other countries, where it may be accessible to foreign courts, law enforcement, and national security authorities under the laws of those jurisdictions.

13. Quebec Privacy Rights (Law 25 / Loi 25)

If you reside in Quebec, the Act respecting the protection of personal information in the private sector, as amended by Law 25, applies to your personal information. In addition to the rights described above, you have the following rights:

  • Right to be informed: To know the purposes, means of collection, categories of third parties receiving your information, and whether it is transferred outside Quebec
  • Right of access and rectification: To obtain a copy of your personal information and have inaccurate, incomplete, or equivocal information corrected
  • Right to withdraw consent and de-indexing: To withdraw consent to further use or disclosure, and to request that information about you be de-indexed or ceased to be disseminated in defined circumstances
  • Right to data portability: To receive computerized personal information you provided to us in a structured, commonly used technological format
  • Automated decisions and profiling: To be informed if a decision about you is based exclusively on automated processing, and to submit observations. We do not currently make such decisions
  • Cookies and tracking: Profiling, tracking, and identification technologies described in Section 5 are deactivated by default under Law 25 unless you consent

Before transferring personal information outside Quebec, we conduct a privacy impact assessment to confirm the information will receive adequate protection. Quebec residents may exercise these rights, or raise a concern with our person in charge of the protection of personal information, by emailing info@fondako.com with "Loi 25 Request" in the subject line. You may also file a complaint with the Commission d'accès à l'information du Québec (cai.gouv.qc.ca).

14. California Privacy Rights (CCPA)

California residents have the right to know what personal information we collect, use, and disclose; the right to request deletion; and the right to opt out of the sale of personal information. We do not sell personal information as defined by the CCPA, and we will not discriminate against you for exercising your CCPA rights. 15. European Privacy Rights (GDPR)

If you are located in the European Economic Area, we process your information based on consent, contract, legitimate interests, or legal obligation. You may contact info@fondako.com for GDPR-related inquiries and you have the right to lodge a complaint with your local data protection authority.

16. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on our website, sending an email notification to registered users, and updating the "Last Updated" date. Your continued use of our services after changes constitutes acceptance of the updated Privacy Policy.

18. Recording and Monitoring

We may record phone calls and virtual meetings for quality assurance, training and coaching, appointment qualification verification, and dispute resolution. By scheduling or attending an appointment, you consent to being recorded. Our CRM and appointment systems may include screen recording functionality for quality control and training purposes.

19. Testimonials and Marketing Use

If you provide a testimonial or participate in marketing materials, you grant us permission to use your name, business name, and testimonial indefinitely across our marketing channels, and you waive the right to request removal of published testimonials.
